We are in the process of registering this agent with the United States Copyright Office. Until that registration is on file, this email and address are the working channel for takedown notices.
2. How to send a takedown notice
Under 17 U.S.C. § 512(c)(3) your notice must include all of the following:
- A physical or electronic signature of the owner or someone authorized to act on the owner's behalf.
- Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple.
- Identification of the material on the site claimed to be infringing, with a direct URL so we can find it.
- Your contact information: name, address, telephone number, and email.
- A statement that you have a good-faith belief that the use of the material is not authorized by the owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
Send the notice to hello@highintentmedia.com. We will act expeditiously to remove or disable access to material that is the subject of a complete notice and will notify the user who posted it.
3. Counter-notice
If your content was removed and you believe it was a mistake (for example, the use was authorized or qualifies as fair use), you can send a counter-notice including:
- Your physical or electronic signature.
- Identification of the material that was removed, and the URL where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed as a result of mistake or misidentification.
- Your name, address, telephone number, and email, and a statement that you consent to the jurisdiction of the federal district court in Delaware (or your judicial district if you are outside the US) and that you will accept service of process from the complainant.
We forward complete counter-notices to the original complainant. Unless they file suit within 10 to 14 business days we may restore the material.
4. Repeat infringers
We terminate accounts of users who are repeat infringers in appropriate circumstances. Multiple valid takedowns against the same account is the trigger.
5. False claims
Knowingly making material misrepresentations in a DMCA notice or counter-notice can lead to liability for damages under 17 U.S.C. § 512(f). If you are not sure whether the use is infringing, talk to a lawyer first.
6. Trademarks
For trademark complaints, write to hello@highintentmedia.com with the registered mark, registration number, the URL of the material at issue, and a description of the alleged infringement.
